LLF Prevails on Appeal: Dismissal of Suit for Fraud and Commercial Bad Faith Affirmed
LLF prevailed on behalf of its client, a money center investment bank, in an appeal to the Appellate Division, First Department.
In its decision, the court upheld the trial court's grant of summary judgment to the bank, dismissing plaintiffs' action under the UCC and theories of fraud and commercial bad faith.
The court had held that the plaintiff had failed to adduce any evidence of actual knowledge by anyone at the bank that a fraud was under way.
